Salman Khan can finally heave a sigh of relief as the Mumbai sessions court has ordered a fresh trial in the 2002 hit and run case. Salman had requested for a fresh trial after facing serious charges of culpable homicide not amounting to murder on November 19.
The actor, who was caught in the hit and run case way back in 2002 for allegedly crushing a group of people sleeping on the pavement, leaving one dead and four injured, was charged with causing death by negligence in the initial stages of the case. But recently, on July 24, when the case was being heard in court, as per the given evidence, Salman was charged with culpable homicide not amounting murder under IPC section 304. Also, the actor was also accused of several other sections which include 279 for causing death by negligence, 337 that is causing hurt by an act, 338 - causing grievous hurt, 427 - causing damage or mischief of property under the Indian Penal Code and provision of the Motor Vehicles Act and the Bombay Prohibition Act. This would have resulted in the imprisonment of over 10 years for the actor instead of two years. However, the actor had filed a petition for a fresh trial since he wasn't given an opportunity in the magistrate's court to present his side of witnesses.
Now, the sessions court judge D W Deshpande has agreed for a fresh trial and has asked the prosecution and the defense to submit their list of witnesses on December 23 after which the case would be presented in a fast track court.
