Alec Baldwin faces gun charges for a law that wasn’t passed at the time of the Rust shooting

Baldwin is officially facing charged against ‘involuntary manslaughter;’ and a ‘firearm enhancement’ in the fatal onset shooting of Rust cinematographer Halyna Hutchins. As reported by Variety, the enhancement charge – which carries an additional five-year penalty for discharge of a firearm in the course of a felony – did not become law until May 2022, seven months after Hutchins was killed; making it uncertain whether a judge would permit the prosecution to seek the additional five-year sentence.

A spokeswoman for the office shared that First Judicial District Attorney Mary Carmack-Altwies and her appointed special prosecutor, Andrea Reeb, are currently reviewing the concern. “The District Attorney and special prosecutor are actively reviewing all applicable laws to ensure they have the strongest case to secure justice for Halyna Hutchins,” said the spokesperson.

 

Besides Baldwin, Rust Armorer Hannah Gutierrez-Reed is also facing the same charges of of involuntary manslaughter as well as a firearm enhancement. As per the report, her attorney is seeking to apply the enhancement retroactively, in violation of Gutierrez-Reed's constitutional rights.

 

“We will be addressing this with motions,” Bowles wrote in an email. “They have clearly charged an enhancement that is barred by the constitution and ex post facto law.” The official charges came around two weeks after Mary Carmack-Altwies, the Santa Fe district attorney, first announced that Baldwin and Gutierrez-Reed, who supervised weapons for the film, would be prosecuted.

 

Rust cinematographer Hutchins was shot and killed on October 21, 2021, by a prop gun which turned out to contain live rounds. The gun was held by Baldwin and the actor has since maintained that he did not pull the trigger.
