The new move that Yash Raj Films have opted to retain the music rights on their songs is by asking hotels and restaurants to pay money for the songs they will be playing to entertain their guests and customers. In fact, around 55 hotels which include brands like Marine Plaza, Four Seasons, JW Marriot have been asked to follow these rules and if they fail to abide by it, they may be charged for infringement under Copyright Act of 1957.
As per the license enquiry section on Yash Raj Films website, "Any usage of Yash Raj Films Pvt. Ltd. (YRF) Repertoire, audio or video, in part or full, commercial or non-commercial, attracts a licensing fee. The referenced Repertoire, whether it be in form of a rendition or performance on the YRF original soundtrack would be subject to licensing approvals and payment of requisite fees. This will be applicable for Television shows, commercial endorsements, advertising jingles, documentary & feature films, live shows, any ground event, including artiste concerts, public performance in hotels, malls, bigger establishments etc.
Any public performance or usage of any sound recording or video, in part or full, needs license from Yash Raj Films Pvt. Ltd. under the Copyright Act, 1957. Please note that YRF is not a member of IPRS, PPL, or any of its affiliates or international representations. Since all copyrights vest with YRF, any licensing dues would be collected by us directly."
The hotels and other establishments who play the music of Yash Raj Films will have to pay the required amount to Novex Communication. Adding on their association with Novex, Yash Raj Films' website states, "All Ground Licenses in India (for events, hotels, pubs, etc.) will be issued by our authorized representatives Novex Communication Pvt. Ltd."
A formal letter has been issued by the music label to all these public establishments stating about the above information. The music label sprung into action after they won a recent case in High Court which was ideally filed by the popular pub in Mumbai, Leopold Cafe. This pub had challenged YRF's decision to grant rights of public performance of their music to third parties. After the case was ruled in their favour, the Bombay High Court further added that the agency which is associated with the copyright collection fees should ensure that all those who hold license should have paid the accurate fees.
