Pyar Tune Kya Kiya star Fardeen Khan will stay for at least two more days in the custody of the Narcotics Control Bureau. The special court reserved its judgment on Fardeen's bail application till May 10. Fardeen, arrested on Saturday after being caught red-handed at a Juhu ATM centre accepting a cocaine delivery, was not produced before the court on Tuesday. Ayaz Khan, counsel for Fardeen, argued that the investigation clearly indicated that the entire contraband was seized from peddler Nasir Shaikh, and not Fardeen Khan. Documents filed by the prosecution, including the panchnama recording the events following the NCB swoop, and the remand application show that Fardeen was not a drug dealer, but a consumer who had come to buy cocaine. Khan in his argument stated that the totality of circumstances should be considered in such offences and he should be freed. "He requires a chance. People make mistakes. He will improve. Keeping him in custody will have an impact on his film career," Khan told the court. Special Public Prosecutor Usha Shisodiya argued that the nine grams of cocaine seized during the swoop was found in Fardeen Khan's car. She told reporters: "This is too early a stage to consider a bail application. Though the accused persons have said that only one gram was to be traded between Nasir Shaikh and Fardeen, it is to be proved that the nine grams were not intended for Fardeen."
